Copyright Infringement

Posted by Laura Davis on July 20, 2009 at 3:37 PM

On Friday night, I was writing up several reviews for books that are going to be featured at Interviews & Reviews (speaking of which, if you have a book coming out in 2010 and you would like to be featured at I & R, please contact me soon. If this year is any indication, then next year will be full before October!). Anyway, I googled one of the books I was reviewing, only to find out that almost the entire book was available to read online at Google Books. Surprised that the publisher would allow such a thing (the ending of the book was even included!) I googled my own book and lo and behold there my book was from cover to cover with only one chapter missing! Just like the book I had googled, the ending of my book was also included. I was not pleased.  In fact, I'm pretty sure my blood pressure went through the roof! Google had illegally copied my book and made it available online. Did I give them permission? No!

I didn't know what to do, but I recalled that Google had a class action lawsuit against them for just this very thing, which apparently has already been settled. I filled out a form here and waited to see what would happen. In the meantime, I contacted Lulu (my publisher), because I noticed that they had given Google permission to reprint my book. They had no right to do that, as I own the copyright. They responded to me by saying I had given them permission. By now, my blood was boiling. So, I went on the forums of Lulu to voice my objections. It's amazing what the words copyright infringement, illegal and lawyer will do when you want to get something done! I'm also amazed at how many of my comments were actually deleted from the forums, just because of those words!

Within 3 hours all but 48 pages of my book were gone! In fact, while I was looking at the last page of my book, it disappeared! I still think that 48 pages is far too much for a preview, but when looking at the other books that Google has illegally copied I guess I can't complain.

So, my dear writer friends - check your books! They could be available online for free at Google Books. Oh, and don't be fooled by the first page, where all you see are public domain books. Make sure you actually put your title in the search bar.

Wow, Laura!
What blatant, unethical sass.
Google has so many great things going for it that are helpful to us all. However, your experience is a reminder that it is also big business, and the bottom line is dollars.
I haven't checked on my book yet.
Thanks for alerting us to this.
Peter.

Laura: WOW...I couldn't believe that Google would just about put all of your book online. This is something that I'll investigate with my book and have it stipulated in my contract that only one or two chapters...that I choose will be allowed on google. Good for you for taking this to the next step, if you had too!

Hmm. I'm wondering why your pictures didn't show up!

Anyway, yes Peter it is unethical and it amazes me that when you google Google, you will see quite a few lawsuits against them. Yet they continue to infringe on copyrights and make books available online. I noticed that Mags Storey's book If Only You Knew is up, from beginning to end. I told her and while it seems a few pages are missing now, it is still far too many. Apparently, Kregel gave their permission for a few pages, which apparently Google interprets as 'copy entire book and make available to public for free'.

Ian you are going with the same publisher as Peter and neither one of you has to worry. While Peter's book is shown, there are no preview pages. When I googled other authors that went with Word Alive, they were safe as well.
I'm still amazed at Google's audacity at thinking such a thing would be permissible and that they are still doing it, even after being sued!

Laura,
Thanks for checking up on my book re. Google. I hadn't done a thing. Actually, we've been contending with water supply problems at the old manse here, and have been caught up with cutting openings in ceiling and floor, and removing some sections of ductwork to provide the plumber with access. So my email and Internet activity has been minimal (hmm, and so has my preparations for Sunday).
The situation with Mags's book being put online virtually in complete form is also ridiculous. Thank you for the assurance to Ian and me re. Word Alive.
Lord bless,
Peter.
